1. Agreement

By accessing or using BrightWing Vault, you agree to these Terms of Service. If you do not agree, you must not use the service.

2. Service Description

BrightWing Vault is a cloud-based platform providing file storage, synchronization, and collaboration tools. The service is provided on a best-effort basis.

3. Use at Your Own Risk

The service is provided "as is" and "as available". You use the service entirely at your own risk.

4. No Warranty

BrightWing Tech Solutions makes no representations or warranties of any kind, express or implied, including availability, uptime, reliability, or data integrity.

5. No Critical Use

The service is not designed, intended, or suitable for use in any critical or high-risk environments.

6. Data Responsibility

You are solely responsible for maintaining independent backups of your data.

We do not guarantee data preservation and are not responsible for loss, corruption, or unauthorized access.

7. Third-Party Services

The platform relies on third-party services including Stripe (payments) and Nextcloud (storage infrastructure). We are not responsible for their performance or failures.

8. Limitation of Liability

To the maximum extent permitted by law, BrightWing Tech Solutions shall not be liable for any indirect, incidental, or consequential damages.

Total liability is limited to the amount paid by you for the service in the 30 days preceding the claim.

9. Service Level Disclaimer

The service is provided on a best-effort basis. We do not guarantee uptime, availability, performance, or error-free operation.

10. Arbitration

Any dispute arising from these Terms or the use of the service shall be resolved through binding arbitration in British Columbia, Canada, rather than in court, except where prohibited by law.

11. Class Action Waiver

You agree to resolve disputes on an individual basis only and waive any right to participate in a class action or collective proceeding.

8. Acceptable Use

You agree not to use the service for illegal activity, abuse, or unauthorized access attempts.

9. User Content Responsibility

You are solely responsible for all content stored, transmitted, or processed using the service.

This includes compliance with all applicable laws, including copyright, privacy, and data protection laws.

10. No Monitoring Obligation

BrightWing Tech Solutions does not monitor, review, or control user content and has no obligation to do so.

We reserve the right to suspend accounts, remove content, or terminate access at our sole discretion, with or without notice.

You agree to defend, indemnify, and hold harmless BrightWing Tech Solutions from any claims, damages, or legal actions arising from your use of the service or your content.

15. Account Responsibility

You are responsible for all activity under your account and for maintaining the security of your credentials.

16. Billing

Subscriptions are billed monthly via Stripe. Fees are non-refundable unless required by law.

17. Suspension and Termination

We may suspend or terminate accounts at any time for violations, non-payment, or operational reasons.

18. Data Deletion

Data may be permanently deleted after account termination. Recovery is not guaranteed.

19. Governing Law

These terms are governed by the laws of the Province of British Columbia, Canada.

20. Changes

We may update these terms at any time. Continued use constitutes acceptance.
